München. Aktuelle Fragen des deutschen und amerikanischen Patentrechts stehen heute im Mittelpunkt eines deutsch-amerikanischen Symposiums im Deutschen Patent- und Markenamt in München. 70 Fachleute aus Wissenschaft, Wirtschaft, Rechts- und Patentanwaltschaft diskutieren mit Patent Commissioner Robert Stoll und Kolleginnen und Kollegen aus dem Amerikanischen Patent- und Markenamt (USPTO) und dem DPMA über Aspekte der Patentqualität, alternative Modelle der internationalen Zusammenarbeit, den Schutz biotechnologischer Erfindungen sowie über die sogenannte Erfinderische Tätigkeit als eine der Voraussetzungen für die Erteilung eines Patents.
Die Tagung ist ein Pfeiler der intensiven Zusammenarbeit zwischen dem DPMA und dem USPTO auf dem Gebiet des geistigen Eigentums, die im November 2008 mit der Gemeinsamen Erklärung über die bilaterale Zusammenarbeit begonnen wurde.
"Das gemeinsame Symposium im DPMA bildet den Höhepunkt eines erfolgreichen ersten Jahres, in dem wir uns mit unseren amerikanischen Kollegen vom USPTO fachlich ausgetauscht haben", so Cornelia Rudloff-Schäffer, Präsidentin des DPMA.
Anlass für die Kooperation ist die Suche nach neuen Formen des internationalen Erfahrungsaustauschs und der Zusammenarbeit nationaler und regionaler Patent- und Markenämter weltweit. Präsidentin Rudloff-Schäffer: "Die starke Inanspruchnahme der großen Patentämter weltweit stellt die Patentsysteme vor neue Herausforderungen. Im Interesse unserer deutschen und europäischen Unternehmen ist es unverzichtbar, mit unseren Partnerämtern über neue gemeinsame Standards zu diskutieren."
Mit dem beschleunigten Patentverfahren, das DPMA und USPTO seit April 2009 in einem Pilotprojekt anbieten, können Anmelder die beschleunigte Prüfung beantragen, sofern bei der Partnerbehörde bereits eine Patentvoranmeldung vorliegt. Nähere Informationen zum Verfahren finden Sie hier.

Munich. Current issues of German and US patent law are today in the focus of a German- American symposium at the German Patent and Trade Mark Office in Munich. 70 experts from science and industry as well as lawyers and patent attorneys meet with Commissioner for Patents Robert L. Stoll and other representatives from the United States Patent and Trademark Office (USPTO) and the DPMA to discuss aspects of patent quality, alternative schemes of international cooperation, the protection of biotechnological inventions as well as the so-called inventive step as a precondition for the grant of a patent.
The meeting is a pillar of the intensive cooperation of the DPMA and the USPTO in the field of intellectual property, launched in November 2008 by the signing of a Memorandum of Understanding on bilateral cooperation.
"The joint symposium at the DPMA is the highlight of a successful first year of cooperation in which we discussed IP issues with our colleagues from the USPTO", said DPMA President Cornelia Rudloff-Schäffer.
The cooperation scheme was established with a view to explore new ways of international exchanges of experience and cooperation of national and regional IP offices all over the world. "The high utilisation of the large patent offices around the world causes new challenges for the patent systems," noted President Rudloff-Schäffer. "In the interest of our German and European enterprises, we need to discuss new common standards with our partner offices."
The accelerated patenting process, which the DPMA and the USPTO have offered since April 2009 under a pilot programme, allows applicants to request accelerated examination provided that a corresponding patent application has been previously filed at the partner office.
